Zurzag Terms of Use

1. Nature of the Platform

Zurzag is a data organization, interaction, and information-sharing platform that enables users to create, view, and interact with Points of Contact (POCs), posts, records, and related content.

Zurzag is not:

• a registry of legal ownership;
• a title verification system;
• a law enforcement authority;
• a financial institution; or
• a marketplace intermediary responsible for transactions.

All content on the Platform reflects user-submitted information and assertions, not verified facts.

2. User Responsibility and Warranties

You are solely responsible for all content you submit, including:

• ownership claims;
• descriptions;
• images;
• comments; and
• Lost / Missing / Stolen (LMS) reports.

You represent and warrant that:

• you have the legal right to submit the content;
• your content is not false, misleading, or fraudulent; and
• your content does not violate any law or third-party rights.

You agree not to:

• submit false ownership claims;
• impersonate any person or entity;
• upload sensitive personal data (e.g., government IDs) unless explicitly required; or
• misuse the LMS system.

3. Points of Contact (POCs) — Structure and Non-Ownership

POCs are system-level records within Zurzag.

• Users do not own POCs.
• Users may submit content, associations, or assertions related to a POC.
• Zurzag retains full control over the structure, existence, and management of all POCs.

Submission of content to a POC does not grant ownership, control, or exclusivity over that POC.

4. Ownership Claims and Verification Disclaimer

All ownership-related information is:

• user-asserted; and
• not verified by Zurzag unless explicitly stated.

Zurzag:

• does not confirm ownership;
• does not validate documentation; and
• does not resolve disputes.

5. Lost, Missing, and Stolen (LMS) Content

LMS features allow users to report items or incidents.

You acknowledge:

• LMS reports may be inaccurate or incomplete;
• Zurzag does not verify or investigate claims; and
• Zurzag is not responsible for recovery, enforcement, or dispute resolution.

You agree:

• to contact appropriate authorities for legal matters; and
• not to rely solely on Zurzag for recovery or enforcement.

Zurzag is not liable for:

• false reports;
• failure to recover items; or
• actions taken based on LMS content.

6. Third-Party Services

Zurzag uses third-party providers, including Stripe, for:

• payment processing;
• affiliate payouts; and
• identity verification.

Identity Verification

When you complete identity verification, personal data may be collected by Stripe, including:

• name;
• date of birth;
• government ID information; and
• biometric data (e.g., selfie).

Zurzag typically receives:

• verification status;
• limited identity details; and
• risk indicators.

Zurzag does not guarantee:

• accuracy of third-party verification; or
• completeness of identity data.

Use of third-party services is subject to their terms and policies.

7. Affiliate Program

Zurzag may offer an affiliate program.

You agree:

• participation is voluntary;
• payouts are not guaranteed; and
• earnings depend on valid transactions.

Zurzag:

• is not responsible for affiliate marketing claims;
• may suspend or terminate affiliate accounts at its discretion; and
• may withhold or reverse payouts in cases of fraud, abuse, or violations.

Affiliates are independent participants, not employees or agents.

8. User Content License

By submitting content, you grant Zurzag a:

• worldwide,
• non-exclusive,
• royalty-free,
• perpetual, and
• sublicensable

license to:

• use,
• store,
• display,
• reproduce,
• modify,
• analyze, and
• distribute

your content for:

• Platform operation;
• search and indexing;
• analytics;
• system improvement; and
• AI and automated processing.

You retain ownership of your content, but grant these rights to Zurzag.

9. AI and Automated Processing

Zurzag may use automated systems, including artificial intelligence, to:

• classify content;
• generate descriptions;
• detect fraud or misuse; and
• improve system performance.

You acknowledge:

• AI outputs may be inaccurate;
• AI results are not authoritative or verified; and
• Zurzag is not responsible for decisions made based on AI outputs.

Content may be processed by third-party AI services.

10. Sensitive Data and Image Content

You agree not to upload:

• government identification documents;
• financial information; or
• sensitive personal data,

unless explicitly required by the Platform.

If you upload such data:

• you do so at your own risk; and
• Zurzag is not responsible for misuse, exposure, or unintended processing.

11. Business Interactions and Promotions

Zurzag may allow businesses to:

• create posts;
• share recommendations; and
• offer promotions.

Zurzag:

• does not guarantee accuracy of business content;
• is not responsible for services provided; and
• is not liable for transactions, disputes, or outcomes.

All interactions are between users and businesses directly.

12. Account Control and Termination

Zurzag may:

• suspend or terminate accounts;
• remove content; or
• restrict access,

at its sole discretion, with or without notice.

13. Disclaimers

The Platform is provided “as is” and “as available.”

Zurzag disclaims all warranties, including:

• accuracy;
• reliability;
• availability; and
• fitness for a particular purpose.

14. Limitation of Liability

To the maximum extent permitted by law:

Zurzag shall not be liable for:

• indirect, incidental, or consequential damages; or
• loss of data, profits, or business opportunities.

Total liability shall not exceed:

• the amount paid by you to Zurzag in the past 12 months; or
• $100,

whichever is greater.

15. Indemnification

You agree to indemnify and hold harmless Zurzag from any claims arising from:

• your content;
• your use of the Platform;
• your violation of these Terms; or
• disputes with other users or businesses.

16. Dispute Resolution

These Terms are governed by the laws of the State of Florida.

Disputes shall be resolved through:

• binding arbitration; and
• in Florida.

You waive the right to:

• jury trial; and
• class action participation.

17. Changes to Terms

Zurzag may update these Terms at any time.

Continued use of the Platform constitutes acceptance of changes.
